Conditions of participation
On the official social media channels of Manthey Racing GmbH (Instagram and Facebook), social media users have the chance to win a 99 Euro voucher for the Manthey Concept Store on Ring Boulevard or a cap signed by the Manthey EMA drivers. A total of six winners will be drawn. Participation in the Manthey Racing GmbH competition is subject to these terms and conditions.
1. Organiser
The organiser is Manthey Racing GmbH, Rudolf Diesel Str. 11-13, 53520 Meuspath.
2. Duration
The competition starts on 30.05.2024 at 15:30 pm. The closing date for entries is 31.05.2024 at 15:30 pm.
3. Conditions of participation
The rules of participation are quickly explained: 1. be a subscriber to the Instagram and Facebook channel of Manthey Racing GmbH as well as the Instagram and Facebook channel of Paddock Legends. 2. comment on and like the competition posts on the Instagram or Facebook channel of Manthey Racing. The Instagram post will be played on the @manthey_racing channel as well as on the @paddocklegendsofficial channel, as it is a collab post.
Each participant can only take part in the competition once. Participation is only possible within the participation period. Entries received after the closing date will not be considered in the draw. Participation in the competition is free of charge.
4. Eligible participants
Natural persons resident in Germany who have already reached the age of 16 are eligible to participate. Employees of Manthey Racing GmbH or COLOGNE First Trade GmbH and their family members are excluded from participation.
Manthey Racing GmbH reserves the right to exclude persons from the competition who obtain advantages through manipulation, make use of unauthorised assistance or violate these conditions of participation. In such cases, Manthey Racing GmbH may also subsequently exclude persons from the competition, withdraw or reclaim prizes.
5. Prize procedure
The draw will be random. There will be three winners on Instagram and three on Facebook. There will be one voucher each on Instagram and Facebook and 2 caps per channel. The winner will be announced via direct message and/or comment. Winners will only be contacted via the official Manthey Racing GmbH accounts and will not be asked to follow external links or provide personal information in comments. Manthey Racing GmbH warns against complying with any such requests.

The winners can collect their prizes from the Manthey Concept Store in the Ring Boulevard at the Nürburgring on presentation of their proof of identity and the winning notification from Manthey Racing GmbH.
The competition participant agrees to the usual naming of names in connection with competitions. The competition participant waives any claim to the full mention of his/her name and the copyright from § 13 UrhG in connection with his/her competition entries.
The entitlement to the prize shall lapse if it is not possible to send the prize within 30 days of the first notification of the prize for reasons for which the winner is responsible. Cash payment of the prize is not possible. Winning claims cannot be transferred or assigned to another person. Legal recourse is excluded.
6. Release, rights of use and responsibility
Manthey Racing GmbH is not obliged to check content provided by participants for possible infringement of third party rights; however, it is entitled to reject certain content if, in its reasonable opinion, it is unlawful or immoral or if there is a risk that third party rights may be infringed contrary to the following declaration.
By uploading content such as images and texts, the competition participants declare that this content is free from the rights of third parties and that the content originates from them or that they have obtained the consent of the authors as well as the consent of the persons depicted in the case of images.
The competition participants indemnify Manthey Racing GmbH from all claims of third parties that have arisen due to the content that is/was provided - and agree to support Manthey Racing GmbH in any reasonable way in the defence of such claims.
The competition participants hereby declare that the entries may be distributed, used and made accessible to the public and third parties in all other ways by Manthey Racing GmbH in the context of the competition, its handling and advertising in online media (e.g. on the website or on Instagram) and offline media (e.g. in print).
In addition, the competition participants agree that the content provided as part of the competition may be used for marketing purposes by Manthey Racing GmbH and COLOGNE First Trade GmbH. In this context, the participant is authorised to edit the submitted content and, if necessary, to grant third parties rights of use. This granting of rights of use also includes the possibility that image material can be made available online for retrieval by third parties and that it can be archived. This granting of rights shall be free of charge and free of any spatial, temporal or other further restrictions in terms of content.
7. Liability
The following exclusions and limitations of liability apply to the organiser's liability for damages, notwithstanding the other statutory requirements for claims in accordance with this section:
The organiser shall be liable without limitation insofar as the cause of the damage is based on intent or gross negligence. Furthermore, the organiser shall be liable for the slightly negligent breach of essential obligations, the breach of which jeopardises the achievement of the purpose of the contract, or for the breach of obligations, the fulfilment of which is essential for the proper execution of the competition and on the observance of which the contractual partners regularly rely. In this case, however, the organiser shall only be liable for foreseeable damage typical of the contract. The organiser is not liable for the slightly negligent breach of obligations other than those mentioned in the above sentences.
The above limitations of liability shall not apply in the event of injury to life, limb or health, for a defect following the assumption of quality guarantees for the quality of a product and in the event of fraudulently concealed defects. Liability under the Product Liability Act remains unaffected.
Insofar as the liability of the organiser is excluded or limited, this also applies to the personal liability of employees, representatives and vicarious agents of the organiser.
Manthey Racing GmbH is released from all obligations when the prize is handed over. Manthey Racing GmbH is not responsible for material and legal defects of the prize. The same applies if Manthey Racing cannot (or can no longer) make the prize available due to personal circumstances.
8. Data protection information
Please note the privacy policy of Manthey Racing GmbH. Manthey Racing GmbH collects and uses personal data of the competition participants only if they have consented to it or if it is otherwise permitted by law.
The participant can revoke his declared consent at any time. The revocation must be sent in writing to the contact details of the organiser given in the imprint of the Manthey Racing GmbH website. Once consent has been withdrawn, the participant's personal data collected and stored will be deleted immediately.
9. Conditions and notices from third-party platforms
This promotion is not affiliated with Meta Platforms, Inc. and is in no way sponsored, endorsed or organised by Meta.
Participants in the competition or contest cannot assert any claims against the Instagram and Facebook platforms arising from participation in the competition or use of the competition application. Competition participants acknowledge that neither the competition nor the competition application is supported, sponsored or organised by the Instagram and Facebook platforms or is connected to the platform. Data and information collected or communicated through participation in the competition or use of the competition application by participants will be made available to Manthey Racing GmbH and not to Meta. All notices and enquiries relating to the competition should be addressed to Manthey Racing GmbH - and not to Meta/the Instagram and Facebook platforms.
10. Severability clause
Should any provision of these conditions of participation be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions of these conditions of participation. The invalid provision shall be replaced by a legally permissible provision that comes closest to the economic meaning and purpose expressed in the invalid provision. The same applies in the event of a loophole in these conditions of participation.
